Scope of Work
Matt Quentmeyer is appointed as an individual to act in legal capacities such as a trustee, conservator of the estate, power of attorney for finances, receiver, daily money manager, guardian, or administrator of an estate.
Matt Quentmeyer acts as an owner and manager of Sierra Fiduciary Services, LLC, and may have employees of Sierra Fiduciary Services, LLC, perform tasks such as case management, bill payment, bookkeeping, accounting services, and other ancillary duties.
Confidentiality
Administering an estate is an important and highly personal matter. To be successful, it requires that you disclose information about financial matters and family relationships, which you most likely regard as highly confidential.
Sierra Fiduciary Services, LLC/Matt Quentmeyer will maintain the confidentiality of the information you provide and will not disclose it to persons outside our company to the extent possible.
Please understand Sierra Fiduciary Services, LLC/Matt Quentmeyer may be required to exchange confidential information with accountants, financial advisors, attorneys, and other professionals in the administration of your matter.
Sierra Fiduciary Services, LLC/Matt Quentmeyer will be required to share confidential information freely with the agent on your advanced health care directive.
Sierra Fiduciary Services, LLC/Matt Quentmeyer may also disclose information to a proposed successor fiduciary.
If so, you agree that we may disclose information to them to the extent that it is necessary to facilitate that coordination.
Representation
Sierra Fiduciary Services, LLC/Matt Quentmeyer does hire professional advisors, including attorneys, investment advisors, accountants, realtors, etc., to represent Sierra Fiduciary Services, LLC/Matt Quentmeyer, payable from the client’s estate to help benefit the client or Trust.
Email Communications
There are inherent risks in communicating through the use of email, including confidentiality and security issues.
You agree and consent to Sierra Fiduciary Services, LLC/Matt Quentmeyer communicating with you and your representatives, agents, and others in the course of service delivery through email, including transmission of documents through email.
File Retention
Sierra Fiduciary Services, LLC may keep original documents after all matters have been concluded for a period of time before destroying them.
Sierra Fiduciary Services, LLC/Matt Quentmeyer’s current policy is to retain an electronic version of your file indefinitely.
Electronic Devices and Digital Property
Unless specific written instructions are provided to Sierra Fiduciary Services, LLC, it shall be the default policy that any physical electronic devices owned by the Decedent — including but not limited to computers, smartphones, tablets, external hard drives, and other digital media — may be distributed as tangible personal property to interested beneficiaries of the estate or trust, at the discretion of Sierra Fiduciary Services, LLC.
Sierra Fiduciary Services, LLC/The Trustee shall not be responsible for inspecting, managing, or securing the digital contents (pictures, messages, emails, potentially sensitive files, etc.) of such devices prior to their distribution.
Beneficiaries who receive these devices shall assume all responsibility for any data or content contained therein, including any personal, sensitive, or potentially harmful material and the dissemination of such data.
The trustee may, in their sole discretion, delete or wipe digital content for privacy or legal reasons prior to distribution or consult with a digital fiduciary or professional if necessary.
The trustee shall be held harmless for any loss or exposure of digital content occurring as a result of following this policy.
